Company reserves the right but does not have the obligation to:
We care about the privacy of our users. Please review the Company Privacy Policy. By using the Website or Company Services, you are consenting to have your personal data transferred to and processed in the United States. By using the Website or the Company Services, you are consenting to the terms of our Privacy Policy.
Description. Company offers a text messaging program (the “SMS Program”) through which Company sends SMS and MMS messages to users who have opted in. Your participation in the SMS Program is governed by this section together with the balance of this Agreement and the Company Privacy Policy.
Consent. By providing your mobile telephone number and opting in, you consent to receive text messages from Company at that number, including messages delivered by automatic telephone dialing system or other automated technology. Consent to receive text messages is not a condition of purchase of any product or service and is not required to register for or use the Company Services.
Your representations. In addition to the representations set forth above under “User Representations,” you represent and warrant that you are the subscriber of the mobile telephone number you provide or are expressly authorized by the subscriber to enroll that number in the SMS Program, and that enrolling the number does not violate any agreement between you and your wireless carrier or any third party. Consistent with the eligibility requirements of this Agreement, you further represent that you are not a minor in the jurisdiction in which you reside.
Message types and frequency. You may receive messages such as order, delivery, and account notifications; appointment, coaching-session, and program reminders; benefit or eligibility updates; and replies from customer support. Message frequency varies.
Message and data rates. Message and data rates may apply. You are solely responsible for any charges imposed by your wireless carrier. Consult your carrier or your service plan for details.
How to stop messages. You may withdraw your consent at any time by replying STOP to any message from Company. Company will send a single confirmation message, after which Company will send no further messages under the SMS Program unless you opt in again. You may also opt out by contacting Company at help@attane-health.com or through your in-app account settings. Reply HELP to any message, or contact Company at the address above, for assistance.
Effect of opting out. Opting out of the SMS Program does not terminate your account, does not affect your access to the Company Services, and does not opt you out of email or other communications, which are governed separately by this Agreement and the Privacy Policy. Likewise, unsubscribing from Company emails does not stop text messages; you must reply STOP.
Delivery is not guaranteed. Message delivery depends on your wireless carrier and is not guaranteed. Company is not liable for messages that are delayed, undelivered, or misdirected. Carriers are not liable for delayed or undelivered messages. Not all carriers or handsets support all message types, and carrier participation may change without notice.
Not for emergencies. The SMS Program must not be used to communicate a medical or other emergency. Company does not monitor incoming messages in real time and cannot respond to urgent requests. If you think you are having or may have a medical emergency, call your doctor or 911 immediately, as set forth in the “Disclaimers” section of this Agreement. Nothing in this section limits the “Emergency Services” section below.
No medical advice. Messages sent through the SMS Program are provided for informational purposes only and are subject in full to the “Disclaimers” section of this Agreement, including the provisions stating that Company Content is not a substitute for professional medical advice, diagnosis, or treatment, and that no physician-patient relationship is created by the Website or its use.
Keeping your number current. You agree to notify Company promptly if you change or deactivate your mobile telephone number, by updating your account settings or contacting Company at help@attane-health.com. You acknowledge that if you do not, messages intended for you may be received by a subsequent holder of that number, and you agree to indemnify and hold Company harmless from any claim arising out of your failure to notify Company, in accordance with the “Indemnity” section of this Agreement.
SMS is not legal notice. Notwithstanding your participation in the SMS Program, text messages do not constitute notice under this Agreement. All notices are governed by the “Notices” section below.
Privacy. Information collected in connection with the SMS Program is handled as described in the Company Privacy Policy. Your mobile telephone number and your consent to receive text messages are not sold or shared with any third party or affiliate for marketing or promotional purposes.
Changes and termination. Company may modify or discontinue the SMS Program, in whole or in part, or change this section, at any time, in accordance with the “Modifications” section of this Agreement. Company may also suspend or terminate your participation in the SMS Program at any time, with or without notice.
Disputes. Any Dispute arising out of or relating to the SMS Program, including any claim under the Telephone Consumer Protection Act or any analogous state statute, is subject to the informal resolution, binding arbitration, and class-action waiver provisions set forth in the “Disputes” section of this Agreement.
You consent to Company contacting local emergency services and/or your designated emergency contact in the event that you appear to be in physical or emotional distress during a coaching session, and it is determined that immediate intervention is necessary for your safety.
This Agreement shall remain in full force and effect while you use the Website or are otherwise a user or member of the Website, as applicable. You may terminate your use or participation at any time, for any reason, by following the instructions for terminating user accounts in your account settings, if available, or by contacting us using the contact information below.
WITHOUT LIMITING ANY OTHER PROVISION OF THIS AGREEMENT, COMPANY RESERVES THE RIGHT TO, IN COMPANY’S SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE WEBSITE AND THE COMPANY SERVICES, TO ANY PERSON FOR ANY REASON OR FOR NO REASON AT ALL, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY OR COVENANT CONTAINED IN THIS AGREEMENT, OR OF ANY APPLICABLE LAW OR REGULATION, AND COMPANY MAY TERMINATE YOUR USE OR PARTICIPATION IN THE WEBSITE AND THE COMPANY SERVICES, DELETE YOUR PROFILE AND ANY CONTENT OR INFORMATION THAT YOU HAVE POSTED AT ANY TIME, WITHOUT WARNING, IN COMPANY’S SOLE DISCRETION.
In order to protect the integrity of the Website and Company Services, Company reserves the right at any time in its sole discretion to block certain IP addresses from accessing the Website and Company Services.
Any provisions of this Agreement that, in order to fulfill the purposes of such provisions, need to survive the termination or expiration of this Agreement, shall be deemed to survive for as long as necessary to fulfill such purposes.
YOU UNDERSTAND THAT CERTAIN STATES ALLOW YOU TO CANCEL THIS AGREEMENT, WITHOUT ANY PENALTY OR OBLIGATION, AT ANY TIME PRIOR TO MIDNIGHT OF COMPANY’S THIRD BUSINESS DAY FOLLOWING THE DATE OF THIS AGREEMENT, EXCLUDING SUNDAYS AND HOLIDAYS. TO CANCEL, CALL A COMPANY CUSTOMER CARE REPRESENTATIVE DURING NORMAL BUSINESS HOURS USING THE CONTACT INFORMATION LISTING BELOW IN THIS AGREEMENT OR BY ACCESSING YOUR ACCOUNT SETTINGS. THIS SECTION APPLIES ONLY TO INDIVIDUALS RESIDING IN STATES WITH SUCH LAWS.
If Company terminates or suspends your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, Company reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
To Agreement
Company may modify this Agreement from time to time. Any changes will be posted on the Website and the revision date at the end of this Agreement will be updated. Modifications are effective when posted and apply to your use of the Company Services after that time. Where a change is material, Company will provide notice before the change takes effect, by email to the address associated with your account or by a notice on the Website. If you do not agree to a change, your remedy is to stop using the Company Services and terminate your account as described under “Term and Termination.”
To Services
Company reserves the right at any time to modify or discontinue, temporarily or permanently, the Company Services (or any part thereof) with or without notice. You agree that Company shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Company Services.
Between Users
If there is a dispute between users of the Website, or between users and any third party, you understand and agree that Company is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Company, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or the Company Services.
